Surviving Separation- Putting Children First LINK

This popular and acclaimed 8 week online course will be repeated in October. Every Tuesday evening starting at 6.30 online, it begins on 3rd and continues for 8 weeks. It consists of some formal teaching, discussion, and legal information with invited specialist guests. The course began some five years ago when it was run by FNF East London but has since grown beyond our wildest dreams. All the questions and queries from years of branch meetings in a structured format presented by our experienced and qualified team. For more information, registration and curriculum visit our website LINK.

THE GOOD- FNF IS GETTING NOTICED

1) An important meeting has taken place: between our Chair of Trustees and Sam Morfey, CEO and Lord Younger. Also involved is Prof Christine Davies of Royal Holloway. Who has helped us before.

There will be more, and we have been invited to join working parties.

Younger is junior minister, officially ‘Parliamentary Secretary of State’ in the Department of Work and Pensions. This deals with the social security/benefits system. His brief includes Child Maintenance, the Social Security Advisory Committee (to which we make representations), Maternity benefits and ‘parental conflict’. The precise remit of the last is somewhat unclear!

Younger’s commitment to look at child maintenance calculations is most welcome. The organisation of parenting time must be affordable. Sadly, – as we do not need to tell you – this can be a problem particularly at lower incomes and if there is much travel involved.

There are longer term issues too. Particularly over maternity pay and leave. Our stance has been this. There should be paternity leave for when mother and baby both need support.  There should be maternity pay and leave for the time dictated by biology, but no longer.  Thereafter there should be unisex ‘baby care leave’ and benefits.

Younger gave warm praise for our work. So, hopes he will vector other contacts in Government!

2) A meeting has been promised with Sir Robert McFarlane, President of the Family Division of the High Court. In less pompous language, boss of the Family Courts. A likely topic is how to make them less adversarial. As a counter to the demands of other lobbies – see elsewhere – that their main agenda should be preventing children being allowed a relationship with alleged domestic abusers.

MUMS ON THE RUN-FAILED BY THE FAMILY COURT

Mums on the run-Failed by the Family Court LINK

Presented on BBC on Monday 4th September this ‘special’ report by Ed Thomas claims to document the lives of 6 mothers who fled to Northern Cyprus to avoid findings of Parental Alienation against them. At first glance this report appears to document some terrible cases of failure in the family court and how they forced an innocent primary parent to give their child to an abusive father.

THE BAD- CONNECTED TECHNOLOGY AND CHILDREN'S RIGHTS

Concerns about connected technology and children's rights LINK

The Culture Media and Sports Committee launched a review in May last year about connective technology. That means smart speakers, virtual assistants, airtags, wearable fitness trackers, even cars and fridges. They can all be potentially connected to the internet providing the ability for third parties to collect our data. Concerning for FNF-BPM is that this technology can be easily used for remote stalking in abuse cases and for tracking our children’s location, choices and without their knowledge build an exploitable database of information about them long before they are 16.

On a first read the report makes some useful recommendations about cross Party support and how to protect our right to privacy, but Todays Family Lawyer LINK concentrates more on the future for technology in family abuse.

Please let us know about any abuse of technology in your Family Court Case.

NURSERY CLOSURES THREATEN FREE CHILD CARE

Nursery closures threaten free child care LINK.

Parents struggling to make a shared parenting arrangement work will be relieved to have the 15 hours of free childcare for over 3 year olds provided by the government, despite them increasing the ratio of staff to children from 1:4 up to 1:5. There is a further increase in free hours due from April 2024. Eligible working parents will get 15 free hours for two-year-olds from September 2024, 15 free hours will be available from nine months, and from September 2025, 30 free hours will be available from nine months until the start of school.

But a recent announcement from the National Day Nursery Association (NDNA) have announced 400 nurseries closed last year, with the sector blaming "chronic underfunding" and rising costs. This of course is no help to desperate parents if by 2025 your child has started school and has no need of the free child-care offer. We would like to point out that care from the other parent is often available loving and free.

THE UGLY-UN SPECIAL RAPPORTEUR AGAINST PARENTAL ALIENATION

Her name is Reem Alsalem appointed in 2021 for a three-year term, and she has produced a report urging the United Nations to urge member states to legislate to ban the use of ‘parental alienation’ theory in all its guises on the grounds that it is not ‘in the best interests of the child’. She claims PA is ‘an unfounded and unscientific concept which is highly gendered’.  LINK

Karen Woodall has written of her objections to the UN  LINK, and like FNF we want to see the evidence. Karen goes further in her critique by questioning that ALsalem’s assertion that alienation is a ‘pseudo-concept’ only used to further abuse of victims from the safety of a family court is, in the absence of evidence, no more than hearsay.

FNF have also written our objections to this report. You can find our report by clicking the title of the article and scrolling down the main website.
